Announcement: Apple Towing Co | Apple Auctioneering Co will be conducting an online-only auction with reserve for Cap One, Inc on behalf of the United States Marshals Service. A $10,000.00 pre-bid deposit is required to bid.

Auction Method: Online-Only Auction.

Auction Conducted with Reserve. The United States Marshals Service reserves the right to approve the final offer made by the successful high bidder, even after the auction bidding closes."  The reserve amount will not be disclosed to the public, and there will not be a "Reserve Met" or "Reserve Not Met" disclosure during the auction.

This asset is offered "As-Is, Where-Is" and ALL PURCHASES ARE FINAL. This asset is offered "AS IS", "WHERE IS" without warranty or guarantee. Information on condition limited and subject to change without notice. Bidders may obtain additional information by attending the live preview and visually inspecting the asset. It is the responsibility of the bidder to have thoroughly inspected the asset and to have satisfied him or her as to its condition and value and to bid based upon that judgment solely. ALL PURCHASES ARE FINAL.

NOTICE OF DAMAGE HISTORY: PARTIALLY SUBMERGED & RESTORED. In 2012, the lowest level of the yacht was completely underwater, while the second level of the vessel was partially submerged.

No Buyer's Premium: Successful high bidder will only pay the winning bid amount.

Live Preview, In-person Inspection: Inspection is by appointment only. Attendants must check in and provide a valid ID to enter. Attendants are only authorized to visually inspect the asset and take photos/videos.

Auction Dates & Times:

• Online bidding opens (Tuesday, 5/31/2022 12PM ET).

• Online bidding closes (Tuesday, 6/14/2022 12PM ET).

How to Register: There will be a $10,000.00 pre-bid deposit required prior to registration. The information provided when registering will be the information assigned on the Coast Guard Bill of Sale. If you choose to have your purchase in a business name, the business name and address needs to be utilized. Information will not be verified prior to the execution of the Coast Guard Bill of Sale.​​

1. Enter the online auction.

2. Create an account by clicking "Login/ New Bidder" in the top menu bar, or by clicking the red "Register to Bid" button in the auction listing. First time participants will then click the yellow "Register Here" button. Follow the prompts to complete your account information, accept the Terms & Conditions, and sign-in to the auction.

Deposit Instructions:

There will be a $10,000.00 USD pre-bid deposit required to bid. Deposit will be applied to the purchase price.

There will be (one) $10,000.00 USD refundable pre-bid deposit required prior to placing a bid in this auction.  Pre-bid deposits for all online bidders must be received by (Monday, 6/13/2022 12PM ET). Pre-bid deposits received after this deadline will not be accepted. If you are the successful high bidder, your $10,000.00 deposit will be considered a $10,000.00 down payment. All pre-bid deposits for unsuccessful bidders will be refunded within 5-7 business days. If full payment is not received by the high bidder by (Friday, 6/17/2022 12PM ET), the $10,000.00 deposit becomes non-refundable at which point the property shall revert back to the government without further notice to the bidder and will result in any monies paid, rights, title and interest the bidder may have acquired being forfeited. The transaction shall be null and void as to the purchaser and the asset will either be processed for resale in a subsequent auction or offered to the second highest bidder at their last bid amount.

1. Register: Prior to submitting your pre-bid deposit, you are required to register for this auction online. Please note: If you do not register prior to submitting your deposit, we have no way of approving your account once your deposit is received. Enter the online auction, then create an account by clicking "Login/ New Bidder"  in the top menu bar or the red "Register to Bid" button. Follow the instructions provided. If you have already done so, please proceed to Step 2. 

2. Complete the (Request Wire Instructions Form).  All deposits must be submitted by method of wire transfer. Bidding in this auction will not be permitted unless the wire deposit has been received and posted to our account. Bid permissions will not be provided for "Pending" wires that have not yet posted. Failure to provide a deposit by (Monday, 6/13/2022 12PM ET) will preclude participation in this auction.

3. Once your deposit has been submitted: Please allow up to 24 hours for the sales team to approve your account. 

4. Once your deposit is received, your bidding privileges will be updated. You will receive a confirmation email once you have been approved and at that time you may login to begin bidding. Once again, If you do not register for the auction online prior to submitting your deposit we have no way of adjusting your bidding privileges.

How to Bid:​

1. Once your pre-bid deposit has been received, and you have been approved to bid you may login to the online auction.

2. You may click the yellow "Bid" button on the right hand side for a one time bid, or enter your "Maximum Auto Bid" by selecting the lot and physically typing in the highest you are willing to bid for that item. When placing your "Maximum Auto Bid" the website will bid on your behalf up to the amount you enter by the preset bid increment. The maximum auto bid will continue to be in effect for the high bidder until the max bid amount is exceeded. High bidder will only pay one increment more than the competing bidder.

What to expect once the auction closes:

1. Once all items in the auction close, email notifications will be sent (from bidresults@appletowing.com) to all participating online bidders with the final results. For each lot the bidder bids on it will list "won" or "outbid." The auction company will be seeking final approval from the U.S. Marshals on all lots at this time. 

2. Once approval is received, high bidders will receive an email (from approval@appletowing.com) with payment instructions. Please check your email (and junk mail) periodically after receiving this notice. Payment must be RECEIVED by (Friday, 6/17/2022 12PM ET).

3. Once payment is received, the auction company will execute the sale documents and email them to the buyers via DocuSign for electronic signature. 

4. Once documents are signed by the buyer, Property Release documents will be emailed to the buyer as well as the property custodian.

5. Once Property Release email received, buyer must immediately contact the property custodian to schedule property removal. 

6. Original title documents will be executed and submitted directly from the U.S. Marshals Service.

Payment Collection & Deadline: Full payment must be received by (Friday, 6/17/2022 12PM ET). All payments must be submitted by method of wire transfer. Account information and payment instructions will be emailed to all successful online bidders.

Release & Removal: Storage arrangements as of the auction date are solely between the buyer and the storage facility. Buyer must immediately arrange for removal from the Tahoe Keys Marina 530-541-2155 or enter into a new agreement.

Terms & Conditions: It is the Bidder's responsibility to understand and comply with the complete Terms & Conditions of the auction.

Accommodations: The closest airport to Tahoe Keys Marina is Reno-Tahoe International Airport (63 miles).
